A blind employee of the U.S. Department of Agriculture whose administrative complaints were unsuccessful failed to state a viable claim that the federal agency violated Section 508 of the Rehabilitation Act by not ensuring that USDA’s electronic information and technology is accessible to their employees with disabilities, a District of Columbia federal district court ruled. The court concluded that the Rehabilitation Act doesn’t provide her with a cause of action, and denied summary judgment on that basis, but it will set a hearing to discuss her two remaining Administrative Procedure Act claims.
